Rivers: Embattled Minority Leader Sues APC, Others

The embattled Minority Leader of the Rivers State House of Assembly, Hon Benibo Frederick Anabraba, has instituted a suit against the All Progressives Congress (APC) challenging his expulsion from the party by the State Working Committee (SWC) of the party.The partys SWC, had in a letter dated January 27, 2017, and signed by the state chairman, Dr. Davies Ibiamu Ikanya, expelled Anabraba from the party, for alleged anti-party activities.Anabraba had been having a running battle with the party after he was controversially elected Minority Leader of the House against the wish of the APC.Joined as defendants are; the All P Progressives Congress (1st defendant), Davies Ibani Ikanya, State APC Chairman, (2nd defendant), Hon John Josiah Olu, (3rd defendant), Speaker Rivers State House of Assembly, (4th defendant) and the Rivers State House of Assembly, (5th defendant).Anabraba, in the Originating Summons is praying the court to determine among things; whether having regards to the provisions of sections 95(1), 96 (1) 98(1) and (2) and 101 of the 1999 Constitution as amended and Order 10(1) of the Standing Orders of the Rivers State House of Assembly, 1999, the Plaintiffs election as the Minority Leader of the 5th defendant is constitutional and legally valid.
